Just saw this now. Absolutely disgusting sentence.
Hope your brother is holding up all right in there. Fingers crossed his appeal goes through soon.

If you feel strongly about Hereford, then I suggest complaining to the local police/football licensing authorities about the use of smoke bombs and the fact the perpetrators were not punished. If you want the inconsistencies ironed out then you need to make sure they are shown in the first place. It won't get the lad out of jail, but it will raise the issue.

Granted, but if the courts feel that such a sentence is appropriate then it should be applied uniformly surely?

Surely amongst all the posters on here..there must be a few solicitors / lawyers? Can any one help this lad? Probably too late to get him out early, but what about an appeal?

Trouble is its politically correct and liberal to pick on football fans - you can get arrested and heavily punished for being somewhere you are not supposed to be - like on the pitch (even in a non-agressive way), yet be an illegal immigrant and not supposed to be in the country and you get treated with kid gloves, benefits a free house etc., or at least so it seems. This seems to be the latest area for 'focus' I see 4 Shrewsbuty fans have been arrested for letting off a firework at Leeds.

Off topic, and I'm not sure why you're bringing immigration into this, but how ever things might "seem", illegal immigrants get no benefits and certainly no "free house": From fullfact.org/blog/pension_immigration_asylum_seekers-6689: "... illegal immigrants are by definition unable to qualify for benefits, since applying for benefits would bring their presence to the attention of immigration authorities." " Asylum seekers cannot claim mainstream benefits. Those who are destitute may be eligible for accommodation and financial support in the form of vouchers from the UK Border Agency. The House of Commons Library states that a single person will normally receive £36.62 per week, while a couple would get £72.52." " Refugees [are] asylum seekers whose application to stay in the country has been successful. They are entitled to the same benefits as UK nationals." My emphasis. It's important to get the facts and terminology right with an emotive subject like immigration IMHO. [Edit: emphasis added. By the way, I don't disagree that football fans are harshly treated by the police and courts - I've never been in trouble myself, or done anything that would warrant it, but I've seen others treated heavy-handedly on plenty of occasions.]

[Edit: emphasis added] Important points HY, the term 'illegal immigrants' is banded around way too easily, and most of the time in the wrong context.

Bit harsh. Seems a reasonable hypothesis, apart from the complete misuse of the terms "politically correct" and "liberal". And the apparent outrage at anyone being arrested for breaking the law. And the confusion between asylum seekers and illegal immigrants and their comparative rights.

Not quite as some would believe. You can of course be an illegal immigrant then move through other status categories to claim said benefits as many have pointed out - Migration watch for one. I was though taking one example centered on 'place' to illustrate how the law has been changed and developed to penalise football fans at the comparative expense of others. Yes it is breaking the law to go on the pitch (and I am not arguing a defence against that) but the law was changed to make it so. It is not against the law to invade other things in the same way - as football specific laws have been created.

Trouble is its politically...liberal to pick on football fans By definition it is not liberal to pick on anybody. Which certainly does not change the fact that there has been, at least to my mind, a serious miscarriage of justice here.

This is an absolute joke,Clarkeson was right this country is now just a joke, no one can say boo to a goose! - Good luck Roley the worlds gone mad!!!! 1. The sentence is certainly an absolute disgrace, completely out of proportion to the offence; 2. Clarkson is never right, unless he's talking about cars, the only thing he knows anything about; 3. This country is not a joke. A joke is a tale designed to make others laugh; 4. I don't think any goose was involved, but if one had been I'm sure nature-loving Tank would not have said boo to it.

The fact that all people are not being treated equally was the point being made and therefore the statement stands.

Great news about the appeal. 100 hours community service and 3 year ban.
Will he have to do the 100 hours community service or is it considered spent for the time he's been in prison?

So the appeal has resulted in a radically reduced sentence. Let's hope this reflects badly on the original judge who get it so hopelessly, pathetically wrong. Presumably someone from the Law Society (or whatever) keeps a check on these things?

His mum told me that the bloke that presided over his first court appearance was some district judge, not a usual magistrate.

Well District Judges are higher up the judicial hierarchy than magistrates, so should have been trusted to reach a reasonable verdict. Disgraceful episode.

If he was due to be released next week anyway it seems a bit harsh to be now ordered to serve 100 hours community service.
